Terms of Service

In our facilities

Objective.-

These Terms of Service are an integral part of the CONTRACT FOR MEDICAL SERVICE entered into between the USER and Yeux Clairs Laser, S.A. de C.V. (hereinafter called “YEUX CLAIRS”), and its purpose is to establish the general regulatory framework to which the users of the SERVICES and FACILITIES of YEUX CLAIRS will be subject to regulate the terms, conditions, rules of use, behavior, and interaction between USERS and PERSONNEL, which the USER undertakes to comply with so that YEUX CLAIRS can provide the SERVICES in conditions of safety, order, hygiene and quality, for the benefit of the USER and all people.

Definitions.-

FACILITIES:

FACILITIES are considered to be the property, furniture, goods, equipment, consumables and/or accessories that YEUX CLAIRS has to provide and/or facilitate the SERVICE.

PERSONNEL:

Any person who works at YEUX CLAIRS is considered PERSONNEL, whether under contract, subcontract or fees.

SERVICE:

A SERVICE is considered to be the provision of the service specified in the “Service Contract”, which will be made by YEUX CLAIRS PERSONNEL for the benefit of the USER.

USERS:

USERS of the SERVICES and FACILITIES are all consumers, service applicants or their legal representative, their companions, representatives, servers, and/or employees who go to YEUX CLAIRS establishments and request or have requested attention, or come on behalf of another person who is or has been a user of the SERVICES or FACILITIES.

Terms of Service.-

Identification:

  1. All USERS are required to identify themselves by means of an official identification. Any of the following is considered official identification:
    1. Identification Card.
    2. Voting Card.
    3. Passport.
    4. Driver’s Licence.
    5. Social Security Credential.
  2. In the case of foreign USERS, the equivalents of the previously mentioned official identifications, issued by their country of origin, are accepted.
  3. In the event that the USER presents any identification not previously mentioned, said identification must have been issued by a governmental institution in their country of origin, and must have the full name and photograph of the USER.
  4. If the identification presented, in the opinion of the PERSONNEL, has signs of having been altered or has characteristics that make it easily alterable, it will not be accepted and you will have to present another official identification.

Behavior:

  1. YEUX CLAIRS reserves the right of admission and to grant treatment to any person or USER, at any time, such as:
    1. That comes for different purposes other than to consume the SERVICES offered by YEUX CLAIRS.
    2. That the capacity of the establishment has been exceeded.
    3. To come outside of service hours.
    4. Manifest aggressive attitudes or provocation of altercations.
    5. Wear clothing or symbols that incite xenophobia, racism or sexism.
    6. That causes situations of danger, harassment, discomfort or inconvenience to PERSONNEL or to other USERS.
    7. That present poor hygiene conditions.
    8. That is consuming alcohol, drugs, narcotic substances, psychotropic substances, or shows obvious signs of having consumed them, or signs of a hangover.
  2. Respect the privacy and rights of PERSONNEL and other USERS.

Facilities:

  1. In order to protect the privacy of all USERS, PERSONNEL, and the intellectual property of YEUX CLAIRS, it is prohibited to take photographic images, videos or audio records in the FACILITIES.
  2. Consuming food in the FACILITIES is prohibited.
  3. Smoking or drinking alcoholic beverages in the FACILITIES is prohibited.
  4. The USER agrees to the proper use of the FACILITIES. Any damage to the FACILITIES must be paid by the user who caused said damage, covering the total amount of the repair or replacement, whose decision to be repaired or replaced will only be made by YEUX CLAIRS.

Puntuality:

  1. Any rescheduling of USER appointments must be notified at least 24 hours in advance.
  2. The USER agrees to arrive at the FACILITIES 15 minutes before the appointment. There will be a maximum tolerance of 15 minutes after the established appointment time. After this, the appointment will be rescheduled and there will be no obligation on the part of YEUX CLAIRS to attend the USER before the rescheduled appointment.
  3. In the event that the USER misses their appointment, prior to signing the Service Contract, they will be required to pay for the SERVICE in advance, non-refundable and valid for one year, in order to schedule future appointments.
  4. In the event that the USER misses a scheduled appointment and already has the Service Contract signed, said appointment will be rescheduled at the USER’s convenience as long as there is availability in the YEUX CLAIRS agenda and it is within the term established in the Contract of Service.
  5. In the event that the USER changes their previously scheduled appointments on 3 or more occasions, they will be required to pay for the SERVICE in advance, non-refundable and valid for one year, in order to schedule future appointments.

Risks prevention:

  1. The USER undertakes to follow the instructions and precautions given by YEUX CLAIRS PERSONNEL regarding the prior preparation, during, and after each episode of the contracted SERVICE.
  2. The USER agrees to follow the recommendations of YEUX CLAIRS medical PERSONNEL on the use of medications and the minimum separation between sessions. In case of not following these recommendations, the USER detaches YEUX CLAIRS and all its PERSONNEL from any consequence or complication that may occur.
  3. YEUX CLAIRS and its PERSONNEL reserve the right to make appointments or continue the contracted SERVICE, temporarily or permanently, in the event that the USER presents a complication, risk situation or failure to follow the instructions and precautions that, to judgment of YEUX CLAIRS or its PERSONNEL, could cause damage or aggravate a condition if the contracted SERVICE is started or continued.

Payments:

  1. The USER undertakes to pay in time and in full for the SERVICES contracted.
  2. Only the SERVICES contracted and paid for will be carried out. No SERVICES will be granted without the corresponding payment or free, without any exeptions.
  3. Any consultation or procedure not contemplated within the contracted SERVICES will have to be paid by the user, in addition to the contracted SERVICE.
  4. Having a complication, an unsatisfactory result or any other problem derived from the attention does not exempt the payment of the SERVICE provided, nor is it a reason for reimbursement of the SERVICE provided.
  5. No USER can schedule new appointments if there are debts in the SERVICE already made.
  6. All payments must be made before starting the contracted SERVICE.

Prices:

  1. All prices are subject to change without prior notice.
  2. Prices expressed in currencies other than the Mexican Peso must be paid in their equivalent in Mexican Pesos (MXN).
  3. Prices expressed in United States Dollars (USD) must be paid in Mexican Pesos (MXN) at the exchange rate published by the Official Gazette of the Federation (Diario Oficial de la Federación: https://www.dof.gob.mx/) on the day of payment.
  4. All the revisions, evaluations or unscheduled visits, or appointments to sessions in which the USER decides not to do the session, incur a cost of $60 USD for every 30 minutes.
  5. The cost of the initial evaluation is $130 USD. This cost is exempt if the contracted SERVICE starts at the end of the evaluation, on the same day, and only the contracted SERVICE will be charged.

Communication:

  1. There is no obligation on the part of the PERSONNEL to answer to any communication outside of their working hours with the USERS.
  2. There is no obligation on the part of the PERSONNEL to make evaluations, give diagnoses or medical indications by any means other than in person.
  3. In the event that the USER has a comment, suggestion or complaint about the SERVICES or FACILITIES, he may send it via email to: info at yeuxclairs.com

YEUX CLAIRS will apply the disciplinary measures and sanctions that in its opinion merit, including the temporary or permanent denial of the SERVICE, when the provisions contained in these Terms of Service are violated. The application and interpretation of these Terms of Service, as well as the resolution of situations not provided for therein, will be the sole and exclusive power of YEUX CLAIRS.

Notice of Privacy

In compliance with the Federal Law on Protection of Personal Data Held by Private Parties, we inform you that Yeux Clairs Laser, S.A. de C.V., with address in Hidalgo pte. 2425 int. 702 and 714, Col. Obispado, C.P. 64060, Monterrey, NL, Mexico, is responsible for the use and protection of your personal data, which will be used for the identification, operation, administration and those treatments that are later identified, and that are necessary for the fulfillment of its processes administrative and/or operational.

I. Purpose of the processing of personal data

The personal data collected by Yeux Clairs Laser, S.A. de C.V. will be used for the following purposes, these being applicable to people who come to request our laser induced iris depigmentation procedure services.

  1. Validate the information and documentation of the owner.
  2. Manage the payment of our services.
  3. Provide guidance and medical advice.
  4. Creation, study, analysis, updating and conservation of the clinical record.
  5. Preservation of medical records to follow up on consultations and conditions.

Additionally, we will use your personal information for the following purposes that are not necessary for the fulfillment of our administrative and/or operational processes, but that allow and facilitate us to provide you with better service:

  1. Conduct surveys and obtain your feedback to improve our services.
  2. Advertising offer about promotions in our services.

In case you do not want your personal data to be processed for these additional purposes, from this moment you can communicate the above by sending an email to the personal data department at the following address: info at yeuxclairs.com. The refusal to use your personal data for these purposes may not be a reason for us to deny you the services that you contract with Yeux Clairs Laser, S.A. de C.V., and in accordance with the Law, will have a period of five business days to express it.

II. Personal data used for theses purposes

To carry out the purposes described in this privacy notice, Yeux Clairs Laser, S.A. de C.V., who acts as a responsible legal person, will use the following personal data: identification data, contact data, patrimonial and financial data, and data on physical characteristics.

In addition to the personal data mentioned above, for the purposes of its administrative and/or operational processes, we will use the following data considered sensitive, which require special protection, such as: health data, data on sexual life, and data on ethnic or racial origin.

III. With whom and for what purpose is your personal information shared

Yeux Clairs Laser, S.A. de C.V. shares your personal data with the following people, companies, organizations and authorities other than us, for the following purposes:

IV. ARCO rights

You have the right to know what personal data we have about you, what we use them for and the conditions of use that we give them (Access). Likewise, it is your right to request the correction of your personal information if it is outdated, inaccurate or incomplete (Rectification); that we delete it from our records or databases when it considers that it is not being used in accordance with the principles, rights and obligations provided by the Law (Cancellation); as well as oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.

Any owner or, where appropriate, their legal representative may exercise the ARCO rights, and Yeux Clairs Laser, S.A. de C.V. will provide the means that allow the timely exercise of their rights. The exercise of ARCO rights may be requested by sending an email to the personal data department at the following address: info at yeuxclairs.com.

The written request for the exercise of ARCO rights must contain and accompany the following:

  1. The name of the owner and email to communicate the response to your request.
  2. The documents that prove identity (voting credential or valid passport or professional identification card or valid national military service card or, resident card in the case of foreigners), or, where appropriate, the legal representation of the holder.
  3. The clear and precise description of the personal data with respect to which one seeks to exercise any of the aforementioned rights, and
  4. Any other element or document that facilitates the location of personal data.
  5. In the case of rectification requests, the owner must indicate the modifications to be made and provide the documentation that supports his request.

Yeux Clairs Laser, S.A. de C.V. will notify the owner in twenty business days, counted from the date on which the request for access, rectification, cancellation or opposition was received, the determination adopted to the effect that, if appropriate, it becomes effective within the fifteen days following the date on which the response is communicated. In the case of requests for access to personal data, delivery will proceed, after accreditation of the identity of the applicant or legal representative, as appropriate. The aforementioned terms may be extended only once for an equal period; as long as the circumstances of the case justify it. The answer will be given electronically to the email address specified in the request.

The obligation to access the information will be deemed fulfilled when the personal data is made available to the owner; or, by issuing simple copies, electronic documents or any other means that Yeux Clairs Laser, S.A. de C.V. provide the owner.

In the event that the owner requests access to the data, and Yeux Clairs Laser, S.A. de C.V. is not responsible, it will be enough that this is indicated to the owner by any of the printed means (letter of non-origin) or electronic (email, optical media, etc.), to have the request fulfilled.

Yeux Clairs Laser, S.A. de C.V. may deny access to personal data, rectification, cancellation or concession of opposition to the treatment of these, in the following cases:

  1. When the person requesting it is not the owner of the personal data, or the legal representative is not duly accredited for it;
  2. When the personal data of the person making the request is not found in its database;
  3. When the rights of a third party are injured;
  4. When there is a legal impediment, or the resolution of the competent authority that restricts access to personal data or does not allow their rectification, cancellation or opposition;
  5. When the rectification, cancellation or opposition has been previously made;

Yeux Clairs Laser, S.A. de C.V. will limit the use of personal data and sensitive personal data at the express request of the owner, and will not be obliged to cancel personal data when:

  1. It refers to the parties of a private, social or administrative contract, and are necessary for its development and fulfillment;
  2. In the case of public court agreements and contracts;
  3. They must be treated by legal provision;
  4. Obstruct judicial or administrative actions related to tax obligations, the investigation or prosecution of crimes, or the updating of administrative sanctions;
  5. Are necessary to protect the interests legally protected by the owner;
  6. Are necessary to carry out an action or based on the public interest;
  7. Are necessary to comply with an obligation legally acquired by the owner, or
  8. Are the object of treatment for the prevention or medical diagnosis or the management of health services, provided that said treatment is carried out by a health professional subject to a duty of secrecy.

The aforementioned department will provide you with the necessary attention for the exercise of your ARCO rights and/or revocation of consent and/or limitation-disclosure of your personal data.

VI. Revocation of consent for the use of your personal data

You can revoke the consent that, in your case, you have given us for the processing of your personal data. However, it is important that you bear in mind that not in all cases we will be able to respond to your request or terminate the use immediately, since it is possible that due to some legal obligation we will need to continue treating your personal data. Likewise, you should consider that, for certain purposes, the revocation of your consent will imply that we cannot continue to provide the service you requested, or the conclusion of your relationship with us.

The revocation of consent can be made at any time, without retroactive effects being attributed. To start the revocation process, you must precisely indicate the consent you wish to revoke by sending an email to the aforementioned address, and it must also contain and accompany the following:

  1. The name of the owner and email to communicate the response to your request.

  1. Your registration in the Public Registry to avoid Advertising, which is in charge of the Federal Consumer Prosecutor’s Office (“PROFECO” by its initials in Spanish), so that your personal data is not used to receive advertising or promotions from companies of goods or services.
  2. Your registration in the exclusion list, your own, so that your personal data is not processed for marketing, advertising or commercial prospecting purposes on our part.

VIII. Use of tracking technologies on our website

Our website can save “cookies” on your device to remember your preferences and analyze your use of it. If you continue browsing it will be understood that you give your consent for the placement and use of said “cookies”. However, you can modify and delete your preferences at any time.

IX. Modification of the Privacy Notice

This privacy notice may undergo modifications, changes or updates derived from new legal requirements; of our own needs, for the products or services we offer; of our privacy practices; Changes in our business model, or other causes.

If you consider that your right to the protection of your personal data has been harmed by any conduct or omission on our part, or you presume any violation of the provisions set forth in the Federal Law on Protection of Personal Data Held by Private Parties, its Regulations and other applicable regulations, you may file your disagreement or complaint with the National Institute of Transparency, Access to Information and Protection of Personal Data (“INAI” by its initials in Spanish).
